I have read this Waiver and Liability Release and fully understand that by signing this Waiver and Liability Release, I am giving up legal rights and/or remedies which may otherwise be available to me regarding any losses I may sustain.

I hereby acknowledge that I am voluntarily participating in Animal/Pet Training with A Fox and Hounds (the "Training Company"). The Training Company will exercise all reasonable care and precautions to keep all persons, pets, and property safe during training sessions (including while traveling to and conducting off-site sessions) in order to prevent injury to any person, property, or other pet. However, because pets can be unpredictable, the Training Company cannot protect against every potential injury, risk, or accident. I understand that pets can be injured or become ill during transportation and understand that every pet reacts differently and that animals, by their nature, are unpredictable. This Waiver and Liability Release is intended to shift the risk of participating in animal/pet training to the undersigned Participant, owner, or guardian (hereinafter, collectively, the "Participant") of the pet participating in training. I acknowledge that I have had the full opportunity to discuss with the Training Company and its authorized representatives any and all concerns I have regarding risks associated with the training program and the transportation and supervision of my pet(s). I hereby accept and assume, without reservation, all risks, regardless of severity, associated with participation in the training program, including, but not limited to: the risks of any and all injuries to myself, my pet(s), my family members or any third parties; the risks that my pet(s) may cause injury to other persons and/or pets involved; and the risks that saliva, water, food, and/or other debris may be present in the training area. Participant, on behalf of Participant and Participant's heirs, legal representatives, and assigns (the "Releasing Parties"), hereby waives, releases, discharges, and covenants not to sue the Training Company and its owners, agents, officers, employees, and other representatives (collectively, the "Released Parties") from any and all liabilities that result in injury to, or the loss of my pet(s), or any other property of Participant which arises in any way out of the transportation, supervision, training or care provided by the Training Company whether caused by an act or omission of Training Company or any other Released Party. Participant, on behalf of Participant and the other Releasing Parties, hereby agrees to defend, indemnify and hold harmless the Released Parties from any and all claims of injury, loss, cost, expenses (including attorney's fees, court costs, and consultant fees), or damage caused by the actions of Participant's pet(s) during the course of the training program, or while Participant's pet(s) is under the care, custody or control of the Training Company. This Waiver and Liability Release shall be legally binding on the Releasing Parties. Should any Releasing Party assert a claim contrary to what Participant has agreed to in this Waiver and Liability Release, the claiming party shall be liable for all expenses (including attorney's fees, court costs, and consultant fees) incurred by both the Releasing Parties and the Released Parties. Every provision herein is intended to be severable. If any one or more of the provisions herein is found to be unenforceable or invalid, that shall not affect the other terms and provisions hereof, which shall remain binding and enforceable. This Waiver and Liability Release shall be governed by, and construed in accordance with, the laws of the State of Massachusetts. This Waiver and Liability Release and the assumption of risk provided for herein are intended to be as expansive, broad, and inclusive as permitted by law. No waiver or modification of any provision herein shall be valid unless expressly agreed to in writing by both the Participant and the Training Company. I, the undersigned, affirm that I am at least 18 years of age and am freely signing this Waiver and Liability Release. I have read this Waiver and Liability Release and fully understand that by signing this Waiver and Liability Release, I am giving up legal rights and/or remedies which may otherwise be available to me regarding any losses I may sustain.
